Are SMS appointment reminders covered by PECR?
A plain appointment reminder is generally different from a marketing text. ICO guidance gives appointment reminders as an example of service messages, and says service messages do not count as direct marketing if they are information-only and contain no promotional content. If the SMS includes offers, promotions, referral incentives or marketing content, PECR rules for electronic marketing are likely to matter.
What should a chiropractic SMS reminder include?
Keep it simple: clinic name, appointment date, appointment time, and a cancellation or change link. Avoid symptoms, diagnoses, treatment names, injuries, test results, personal circumstances or anything that could reveal sensitive health information. Health data is treated as special category data under UK GDPR and needs extra care.
