If someone asks to stop, mark them as opted out in Etisia Contacts. Clinics need an appropriate lawful basis under UK GDPR for using patient contact details, and they should explain how mobile numbers are used in their privacy information. Consent is not the only possible lawful basis for service-related processing, but clinics should still be transparent, record communication preferences and avoid sending reminders to people who have opted out of SMS. Are SMS appointment reminders treated the same as marketing texts?
A simple appointment reminder is different from a promotional SMS. However, if a message promotes services, offers discounts, encourages additional bookings or is combined with marketing, PECR may apply.
