Do Australian salons need consent to send SMS appointment reminders?
A plain appointment reminder with no advertising is generally different from a marketing SMS. ACMA says messages are generally not spam if they have no advertisements and are appointment reminders. Still, salons should be clear when collecting mobile numbers, explain that SMS reminders may be sent, and handle personal information appropriately. ACMA
Does the Privacy Act 1988 apply to every hair salon?
Not always. OAIC says most small businesses are not covered by the Privacy Act, but some are - including businesses over the turnover threshold and certain small businesses in specific categories. Even where a salon is not covered, it is still good practice to protect client contact details, use them only for expected purposes and explain how reminders are handled. OAIC
What should we avoid putting in an SMS reminder?
Avoid private notes, unnecessary service details, personal preferences, payment issues or anything a client may not want visible on their phone screen. A good salon reminder can simply say: business name, appointment date, time and cancellation/change link. Covered entities should also consider APP 6’s principle that personal information is generally used or disclosed for the purpose it was collected, unless an exception applies. OAIC
